Privacy Policy
- ▶ We only collect the information you voluntarily provide — name, email, and project details through our contact form.
- ▶ Your data is used exclusively to respond to your inquiry and deliver requested services. No marketing lists, no third-party sharing.
- ▶ We store data only as long as necessary to fulfill the engagement. Upon completion, your data is purged within 30 days.
- ▶ You can request deletion of all your data at any time by emailing [email protected].
- ▶ We use no tracking cookies, no analytics scripts, and no advertising pixels.
1. Data Controller. CodePeakDigital, registered at 555300, Str. Ioan Virgil Ispas nr. 6, Cisnădie, Romania, is the data controller responsible for the processing of personal data collected through this website.
2. Data Collected. We collect only the personal data you voluntarily submit via our contact form: full name, email address, service interest selection, and free-text project description. No data is collected automatically through cookies, analytics, or third-party tracking mechanisms.
3. Purpose of Processing. Your personal data is processed solely for the purpose of responding to your inquiry, providing requested technical consultations, and delivering contracted services. Legal basis: Article 6(1)(b) GDPR — processing necessary for the performance of a contract or pre-contractual measures.
4. Data Retention. Personal data is retained for the duration of the active engagement plus 30 calendar days following project completion or last correspondence. After this period, all personal data is permanently deleted from our systems.
5. Data Sharing. We do not sell, trade, or share your personal data with any third parties. No data is transferred outside the European Economic Area (EEA).
6. Your Rights. Under the GDPR, you have the right to access, rectify, erase, restrict processing, and port your personal data. To exercise these rights, contact us at [email protected].
7. Data Security. We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction.
Terms of Service
- ▶ Every project begins with a written scope agreement. We deliver exactly what's defined — no hidden fees, no scope creep without written approval.
- ▶ Payment terms: 50% upfront to initiate work, 50% upon delivery. Payments are processed via our secure Stripe integration.
- ▶ Upon final payment, all source code and deliverables are transferred to you. Full intellectual property ownership.
- ▶ We provide 14 days of post-delivery bug-fix support at no additional charge. Extended support available by agreement.
1. Agreement. By engaging CodePeakDigital's services, you enter into a binding agreement governed by these Terms of Service. CodePeakDigital is registered at 555300, Str. Ioan Virgil Ispas nr. 6, Cisnădie, Romania.
2. Scope of Work. All project deliverables, timelines, and pricing are defined in a written proposal or Statement of Work (SOW) agreed upon by both parties prior to commencement. Any changes to the scope require written amendment and may affect pricing and timelines.
3. Payment Terms. Invoices are issued per the payment schedule outlined in the SOW. Standard terms: 50% deposit upon agreement execution, 50% upon final delivery and acceptance. Late payments incur a 1.5% monthly interest charge. All payments are processed through our Stripe integration.
4. Intellectual Property. Upon receipt of full payment, all intellectual property rights, source code, documentation, and deliverables are transferred to the client. CodePeakDigital retains no rights to completed work product.
5. Confidentiality. Both parties agree to maintain strict confidentiality regarding all proprietary information exchanged during the engagement. This obligation survives termination of the agreement by 24 months.
6. Limitation of Liability. CodePeakDigital's total liability under any engagement shall not exceed the total fees paid by the client for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.
7. Termination. Either party may terminate the agreement with 14 days' written notice. In the event of termination, the client is responsible for payment of all work completed up to the termination date.
8. Governing Law. These terms are governed by the laws of Romania. Any disputes shall be resolved through arbitration in Sibiu, Romania.
Refund Policy
- ▶ If we haven't started work, you get a full refund. Simple.
- ▶ If work has begun, we refund the portion of work not yet completed, based on documented project milestones.
- ▶ Once deliverables are approved and final payment is received, refunds are not applicable. Bug fixes are covered under the 14-day support window.
1. Refund Eligibility. CodePeakDigital offers refunds in accordance with the following terms. All refund requests must be submitted in writing to [email protected].
2. Pre-Work Cancellation. If a project is cancelled before any work has commenced (as documented by project management tools or version control activity), the client is entitled to a full refund of any deposits paid within 14 business days.
3. Mid-Project Cancellation. If a project is cancelled after work has commenced, the client is entitled to a refund of fees corresponding to work not yet completed. Completed milestones, as documented in the project management system, are non-refundable. Refund calculation is based on the proportion of the SOW that remains undelivered.
4. Post-Delivery. Upon final delivery and client acceptance, no refunds are issued. Defects or bugs identified within the 14-day post-delivery support window will be resolved at no additional cost.
5. Refund Processing. Approved refunds are processed within 14 business days via the original payment method. Stripe processing fees are non-refundable and will be deducted from the refund amount.
6. Disputes. Refund disputes shall be resolved through good-faith negotiation. If resolution cannot be reached within 30 days, either party may initiate binding arbitration in Sibiu, Romania, in accordance with the rules of the Court of Arbitration.
